Welcome to Bmstars Music Distribution (“Bmstars”, “we”, “us”, “our”). By accessing or using our website, services, platform, or any related offerings (collectively “Services”), you agree to these Terms of Use (“Terms”). If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account, uploading content, or otherwise using our Services you accept and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have permission from a parent or legal guardian. You represent and warrant that you have all rights required to submit content and grant the rights described below.

3. Your Content & Grant of Rights

Content you submit: audio recordings, artwork, metadata, and other materials (“Your Content”). By submitting Your Content to Bmstars you represent that you have the necessary rights to distribute the content.

• License: You grant Bmstars a non-exclusive, worldwide right to distribute, transmit, reproduce, and make available Your Content to digital service providers, streaming platforms and third-party partners for the purpose of delivering distribution services.
• Ownership: You retain ownership of Your Content. We do not claim ownership of your music.

4. Payments, Royalties & Fees

We operate according to the pricing and payout terms published on our website. Royalties and payout timing depend on the platforms and partners (Spotify, Apple Music, Boomplay, etc.). We will make reasonable efforts to process and pay earnings according to the selected payout method. We are not responsible for platform payment schedules or discrepancies from third-party services.

5. Prohibited Content

You must not upload content that:

• Infringes intellectual property or third-party rights;
• Contains hate speech, child sexual content, or unlawful material;
• Violates privacy or contains personal data without consent;
• Promotes illegal activities or malicious software.

We reserve the right to remove or refuse any content at our discretion.

6. Takedowns & Copyright

If you believe content on Bmstars infringes your copyright, follow our copyright takedown procedure by contacting us at info@yourdomain.com. Provide sufficient information and we will respond as required by applicable law.

7. Limitation of Liability

To the maximum extent permitted by law, Bmstars and its affiliates will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to these Terms will not exceed the fees you paid to Bmstars in the 12 months prior to the claim (if any).

8. Indemnification

You agree to indemnify and hold harmless Bmstars from any claims, losses, damages, liabilities, including legal fees, arising out of your violation of these Terms or your infringement of any third-party rights.

9. Termination

We may suspend or terminate your account for violations of these Terms or for behavior we deem harmful to the platform. Upon termination, distribution agreements for already-published content may remain in effect with third-party platforms according to their terms.

10. Governing Law

These Terms are governed by the laws of Tanzania (unless otherwise agreed in writing). For international users, local consumer protection laws may apply.

11. Changes to Terms

We may update these Terms periodically. We will post changes on this page with a new effective date. Continued use after changes constitutes acceptance.
